GENERAL INFORMATIONS

These General Conditions of Sale have as their object the purchase of Terranova Alimenti products carried out remotely via the telematic network on the website www.terranovaalimenti.it, belonging to Terranova Alimenti SR, with registered office in Via Gustavo Roccella 269, Palermo – 90128, P VAT number 03649630823. Each purchase transaction will be governed by the provisions of Legislative Decree 185/99, Legislative Decree. 206/05; the information aimed at the conclusion of the contract will be subject to art. 12 of the Legislative Decree. 70/03 and, as regards the protection of confidentiality, it will be subject to the legislation referred to in Legislative Decree 196/03.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The contracts for the sale of the products on the site www.terranovaalimenti.it are considered concluded at the moment in which the purchase order made by the customer to Terranova Alimenti SRL is received if the latter accepts it. Terranova Alimenti SRL will promptly send the customer a receipt of the purchase order made by the customer. The customer, by sending his purchase order electronically, declares to have read and accepted these General Terms and Conditions and undertakes to observe and respect them in its relations with Terranova Alimenti SRL.

TREATMENT OF PERSONAL DATA

Terranova Alimenti SRL pursuant to art. 13 of Legislative Decree 196/2003 informs that the personal and fiscal data acquired also verbally in reference to the commercial relationships established, provided directly by the interested parties, or otherwise acquired in the context of the activity and of the company, will be processed in compliance with the law referred to, including the confidentiality obligations envisaged by them.
In relation to the aforementioned, the rights referred to in Article 7 of Legislative Decree 196/2003.

OBLIGATIONS OF THE CUSTOMER

The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance. Finally, the Customer is required, once the online purchase procedure has been completed, to print and keep these general conditions of sale, already viewed and accepted during the conclusion of the contract.

DEFINITION OF THE ORDER

By sending the online order, the Customer sends Terranova Alimenti SRL a proposal to purchase the product and / or products included in the cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale.

Terranova Alimenti SRL will communicate to the Customer the acceptance and confirmation of the order.

In particular Terranova Alimenti SRL will not accept orders:

  • if the material was not available in stock at the time of the order;
  • if the customer cannot or does not want to pay using credit cards, Paypal, Bank transfer or Payment on delivery (payment on delivery is only available in Palermo);
  • if the customer is considered fraudulent by the money exchange and transaction systems (Stripe, PayPal or Unicredit);
  • if the customer’s shipping area cannot be reached by the couriers used to deliver the goods;

METHOD OF PURCHASE

The customer purchases the product, whose characteristics are illustrated online in the relative descriptive and technical sheets, at the price indicated therein, to which are added the delivery costs and packaging costs (where applicable).

Before submitting the purchase order, the unit cost of each selected product is summarized, together with the total cost in the event of the purchase of multiple products, any discounts (where applicable), delivery costs and packaging costs.

Once the purchase order has been sent, the customer will receive an e-mail message from Terranova Alimenti SRL containing the following information:

  • Confirmation of receipt of the purchase order;
  • Information relating to the main characteristics of the purchased good;
  • The detailed indication of the price of the products, of the discounts (if applied);
  • Shipping method and its cost;
  • Packaging costs (where applicable);
  • Payment methods;
  • Reference to the general conditions of the contract and to the information about the existence of the right of withdrawal, to the conditions and methods of its exercise displayed on the site.

Following the approval of the Law Decree no. 223 “maneuver bis” Art. 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which came into force on 12 August 2006, which reinstates the obligation to communicate the list of customers and suppliers in the event of an issue invoice, and of Law Decree 78 of 31 May 2010 converted into Law 122 of 30 July 2010, requires customers to communicate VAT, PEC, RECIPIENT CODE and TAX CODE in the appropriate fields on the site.

The following payment methods are available:

  • Credit or debit card : just pay with a credit card, rechargeable or prepaid on the secure SSL circuit;
  • Paypal : you can pay comfortably with your Paypal account in full safety (not available for the purchase of products from Cuba);
  • Bank transfer : make a bank transfer to the account held by Terranova Alimenti SRL. When we receive the order, the goods will be prepared and packed. For the shipment it will be necessary to credit our current account. Below are the bank details for the payment of orders:

  • Apple Pay and Google Pay : as simple as the touch of a finger on the Touch ID, it is not necessary to fill out forms or enter payment information with each purchase. Apple Pay is easy, fast and never shares card data making payments secure and confidential.
  • Cash on delivery : available only for Palermo, it is possible to pay in cash or by credit or debit card via the POS device directly to the consignee or at the cash desk in the case of collection at the headquarters;

For each order Terranova Alimenti SRL issues a regular invoice for the purchase. The invoice will be delivered together with the purchased goods. For any eventuality or information do not hesitate to contact us, our operators will be happy to help you.

SHIPPING AND DELIVERY

The purchased good will be shipped by courier to the address specified by the customer when ordering online. Any specific needs must be reported in the “Order Notes” field on the order summary page. If an incorrect shipping address has been entered, we urge you to communicate the correct address to us via the relevant page Contact us .

Terranova Alimenti SRL guarantees delivery of the goods within 3-5 working days (excluding Saturdays and holidays) from the date of receipt of the confirmation of the transaction. In the event of non-delivery due to the absence of the recipient, at the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender (Terranova Alimenti SRL) and the shipping costs will be charged to the customer.

For shipping outside Palermo, the company relies on external transporters. Costs vary according to the total weight of the goods ordered and according to the selected courier. These costs will be calculated based on the delivery address entered during registration and visible in the order summary.

In case of damage to the product, all our shipments are all insured.
Since the damage is not always evident upon delivery by the courier, to take advantage of this insurance it is essential that in the courier receipt you write the phrase “I accept subject to control”.
In case of evident damage, we suggest that you do not accept the package specifying that the package is damaged.

GUARANTEE OF CONFORMITY AND DEFECTIVE PRODUCTS

The products purchased on the website www.terranovaalimenti.it are subject to the regulations on the sale of consumer goods. The delivered products comply with the characteristics illustrated online in the relative descriptive and technical sheets.

Terranova Alimenti SRL is liable to the customer for any lack of conformity existing at the time of delivery of the goods.

RIGHT OF WITHDRAWAL

The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with Terranova Alimenti SRL, without any penalty and without specifying the reason, within 10 (ten) ten working days from receipt of the goods.
The right of withdrawal is recognized in the consumer in relation to any goods purchased by him on the site www.terranovaalimenti.it

METHOD FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL

The right of withdrawal is exercised by sending, within the aforementioned deadline, a written communication to the address of Terranova Alimenti SRL by registered letter with acknowledgment of receipt.

The notice of withdrawal can be sent within the same term, provided that it is confirmed by registered mail with return receipt within the following 48 hours.

In case of exercise of the right of withdrawal, the communication must be made to the following address:

If the goods have been delivered, the customer is required to return them to Terranova Alimenti SRL within 15 (fifteen) working days from the date of delivery of the goods.

The goods must be returned to Terranova Alimenti SRL complete with all accessories and all that was originally delivered to the customer, as well as packed in its original packaging. The returned product must be accompanied by a copy of the electronic order receipt. The costs of returning the goods to Terranova Alimenti SRL are charged to the customer.

If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, Terranova Alimenti SRL is required to reimburse the sums paid by the customer.

In particular, Terranova Alimenti SRL will proceed free of charge to the transmission of the re-credit order relating to the cost of the goods shipped including shipping costs within 30 (thirty) days from the date on which it became aware of the exercise of the right of withdrawal by the customer. This operation will be carried out through the credit card issuing institution of the credit card used for payment or by crediting the sum to the bank account indicated by the customer.

Terranova Alimenti SRL has the right to reject any product returned with methods other than those specified above, as well as products for which the return costs have not been fully paid by the customer, or the methods and times indicated for the return have not been respected. communication of the exercise of the right of withdrawal.

EXPRESS TERMINATION CLAUSE

In the event of total or partial non-payment of the purchase price of the Terranova Alimenti SRL asset, it reserves the right to declare pursuant to and for the purposes of art. 1456 of the civil code terminated this contract by sending a written communication to the customer’s electronic address.

COMPLAINTS

APPLICABLE LAW AND JURISDICTION

This contract is regulated by the Italian law. The exclusive jurisdiction and forum for any legal action brought by the Purchaser under this warranty or any further legal guarantees will be the Court of Palermo. In case of victory of Terranova Alimenti SRL in a possible legal action, the plaintiff must reimburse Terranova Alimenti SRL for the expenses, including lawyers’ fees and court costs, incurred by Terranova Alimenti SRL for its own defense.

REFERENCE

Although not expressly provided for in this contract, the rules of current Italian law apply.
